Terms & Conditions Agreement

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and Numtix ("we", "us", or "our") regarding your access to and use of the Numtix application, features, software, APIs, and associated web services.

Important: By downloading, installing, or playing Numtix, you confirm that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree to these Terms, you must immediately cease using the application and uninstall it from your device.

1. License & Scope of Service

Subject to your compliance with these Terms, Numtix grants you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use the application on compatible mobile devices for your personal, non-commercial educational and entertainment purposes.

You may not sub-license, sell, rent, lease, distribute, or commercially exploit the application or its content.
We reserve all rights not expressly granted to you under these Terms.

2. User Accounts, Phone Verification & Security

To access synchronized progress features, XP levels, and daily streak tracking, users may register an account using phone OTP verification:

Account Responsibility: You are responsible for maintaining the security of your device and the phone number associated with your account.
Accuracy: You agree to provide accurate information during OTP verification.
Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activities.

3. Acceptable Use & Prohibited Conduct

You agree to use Numtix solely for lawful purposes. You strictly agree NOT to engage in any of the following prohibited activities:

Emulation & Hacking: Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the application or backend APIs.
Automated Cheating: Utilizing bots, automated scripts, memory editors, or fake network requests to manipulate game levels, total XP, correct counts, or daily login streak metrics.
Network Tampering: Attempting to flood, overload, interfere with, or disrupt server infrastructure, API endpoints (`/v1/progress/sessions`), or network connectivity.
Impersonation & Abuse: Creating false accounts or exploiting software bugs to gain unfair advantages over other players.

4. Virtual Items, XP & Game Mechanics

Numtix incorporates virtual progress tracking, Experience Points (XP), levels, coins, hint features, and streak records:

Non-Monetary Nature: All XP, level titles, virtual coins, and hints earned in Numtix are virtual digital assets with zero real-world monetary value.
No Transferability: Virtual content is non-transferable, non-refundable, and cannot be traded, exchanged, or redeemed for physical currency or goods.
Balance Adjustments: We reserve the right to recalibrate scoring multipliers, level formulas, or game balancing rules at any time to maintain a fair learning environment.

5. Intellectual Property Rights

The application and all of its original content, features, and functionality—including but not limited to game algorithms, puzzle logic, user interface design, audio effects, graphic assets, logos, trademarks, and source code—are owned exclusively by Numtix and its licensors.

Any unauthorized copying, modification, distribution, or creation of derivative works based on Numtix content without express written consent is strictly prohibited.

6. Service Availability & App Updates

We continuously improve Numtix to enhance user experience:

We may update, modify, add, or remove game modes, levels, features, or technical endpoints without prior notice.
While we aim for maximum uptime, we do not guarantee continuous, uninterrupted access to cloud synchronization services during server maintenance or emergency updates.

7. Disclaimer of Warranties

Numtix IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE FREE OF ERRORS, VIRUSES, OR TECHNICAL DISRUPTIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Numtix, ITS DEVELOPERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, DEVICE DAMAGE, OR GAME PROGRESS DOWNTIME RESULTING FROM YOUR ACCESS TO OR USE OF THE APP.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall first be attempted to be resolved through informal good-faith negotiation by contacting our support team.

10. Modifications to Terms

We reserve the right to revise these Terms at any time. When updates occur, we will post the updated document with a revised "Effective Date" at the top of this page. Your continued use of Numtix following the posting of changes confirms your acceptance of those modifications.
